Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes the conduct expected of users of Regolith Digital LLC's website at regolithdigital.com and any services we provide. This AUP is incorporated by reference into our Terms of Service. By using the Website or engaging our services, you agree to comply with this AUP.

1. General Principles

Regolith Digital is committed to operating its business lawfully, ethically, and transparently. We expect the same of every user, client, partner, and contractor who interacts with us. This AUP exists to make our standards explicit and to protect the integrity of our Website, our clients, our partners, and the platforms on which our services depend.

2. Prohibited Conduct

You may not use the Website or our services, directly or indirectly, in connection with any of the following:

2.1 Illegal Activity

  • Any activity that violates applicable local, state, federal, or international law;
  • Money laundering, terrorist financing, or facilitation of either;
  • Tax evasion or fraudulent tax reporting;
  • Violation of trade sanctions, export controls, or anti-corruption laws (including the U.S. Office of Foreign Assets Control (OFAC) sanctions programs and the Foreign Corrupt Practices Act).

2.2 Fraud and Misrepresentation

  • Misrepresenting your identity, business, or affiliations;
  • Creating, promoting, or distributing fraudulent products, services, or schemes;
  • Engaging in deceptive advertising or false claims;
  • Phishing, spoofing, or other forms of social engineering.

2.3 Harmful or Abusive Content

  • Content that promotes violence, hatred, or discrimination on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics;
  • Content that exploits, harms, or endangers minors;
  • Harassment, threats, stalking, or doxxing;
  • Defamatory, libelous, or knowingly false statements about identifiable individuals or entities.

2.4 Intellectual Property Violations

  • Infringement of copyrights, trademarks, patents, trade secrets, or other intellectual property rights;
  • Unauthorized distribution of pirated, counterfeit, or unlicensed material.

2.5 Adult, Gambling, and Other Restricted Industries

Regolith Digital does not provide services to, and does not work with clients engaged in:

  • Adult or sexually explicit content, services, or products;
  • Online gambling, sports betting, or lotteries that are unlicensed in the relevant jurisdiction;
  • Recreational cannabis, controlled substances, or paraphernalia (where prohibited);
  • Firearms, ammunition, explosives, or related accessories;
  • Predatory lending, "payday" lending, or other high-cost consumer credit products;
  • Cryptocurrency exchanges, ICOs, or token sales without appropriate licensing and compliance;
  • Multi-level marketing schemes, pyramid schemes, or "get-rich-quick" programs;
  • Sale of any goods or services prohibited by applicable law in the jurisdictions in which they are offered.

2.6 Spam and Unauthorized Communications

  • Sending unsolicited bulk messages (spam) by email, SMS, or other channels;
  • Violating the CAN-SPAM Act (U.S.), CASL (Canada), GDPR (EU/UK), or other applicable communications and data protection laws;
  • Harvesting email addresses or contact information without consent.

2.7 Technical Abuse

  • Introducing viruses, malware, worms, ransomware, or any other malicious code;
  • Attempting to gain unauthorized access to the Website, our systems, or any related networks or accounts;
  • Interfering with or disrupting the integrity or performance of the Website or its underlying infrastructure;
  • Bypassing or attempting to bypass any security or authentication measure;
  • Automated scraping, crawling, or harvesting of data from the Website except as expressly permitted.

2.8 Violation of Third-Party Platform Policies

Many of our services are delivered on or through third-party platforms (Google, Meta, TikTok, YouTube, Shopify, and others). Clients and users must comply with the policies of those platforms. Regolith Digital will not engage in artificial engagement, click fraud, fake reviews, view manipulation, or any other practice that violates a platform's terms.

3. Client Due Diligence

Before entering into a Services Agreement, Regolith Digital may request information to verify the identity, ownership, and lawful operation of prospective clients. We reserve the right to decline any engagement that, in our reasonable judgment, presents legal, regulatory, reputational, or compliance concerns.

4. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at contact@regolithdigital.com with as much detail as possible. We take all reports seriously and investigate them promptly.

5. Consequences of Violation

Violations of this AUP may result in:

  • Suspension or termination of access to the Website;
  • Termination of any Services Agreement, with or without refund depending on the nature of the violation;
  • Reporting to law enforcement, regulators, or affected third parties;
  • Civil action to recover damages or seek injunctive relief.

6. Changes to This Policy

We may update this AUP from time to time. The most current version will always be posted on this page with an updated "Last Updated" date.
